Alongside the specific agreements about your treatment, these general terms apply.

These General Terms and Conditions apply to the formation and the performance of the treatment agreement concluded between you and the care provider.

2 What may the Client expect from the Practitioner and Healthcare Provider?

2.1  Information provision

2.1.1  Comprehensive and honest information

The Healthcare Provider and Practitioner will inform the Client extensively about the options that may resolve the Client's concern. The Client will provide the Practitioner with all relevant information, so that the Practitioner gains a clear picture of the Client's wishes and expectations. The Practitioner will clearly explain the Treatment(s) to the Client and point out the limitations, the risks, the client's duty of care, and the course of recovery.

2.1.2  Cost of the treatment

Where applicable, you will receive a treatment agreement before the treatment begins. This sets out the agreed treatment price. You will receive a quotation on the day of your consultation. When booking a treatment date, we ask you to pay a deposit. This must be paid within 1 week of receiving our emails. If we do not receive the deposit on time, there is a chance your treatment date will be cancelled. The remaining amount may be paid up to 2 weeks before the day of your treatment.

2.1.3  VAT

If the Treatment does not arise from "the medical care of persons", the treatment price will be subject to VAT. At the point of diagnosis by the Practitioner, it will be determined whether the Treatment must be subject to VAT.

2.1.4  Information about the treatment

The Healthcare Provider will ensure that the Client is provided with extensive and comprehensible information about the medical procedure. The Client receives this information during and after the first consultation.

2.1.5  Website

The Client may also find extensive information about the desired or agreed treatment on the Healthcare Provider's website. The FueGenix Haarkliniek website has been compiled with all due care. No rights may be derived from it.

2.2  Qualified practitioners

2.2.1  Quality of the Practitioner

The Healthcare Provider guarantees that the Client is treated by an experienced Practitioner with an impeccable professional record, who is legally permitted to carry out their work. The Practitioner will perform only those Treatments for which they are authorised, trained and experienced.

2.2.2  Availability of the Practitioner

The Practitioner is available to the Client throughout the entire treatment process, or in case of absence has handed over care to a substitute.

2.2.3  Determining the indication

The Practitioner determines the indication, or has appointed an assistant who performs the indication assessment under the Practitioner's supervision. The Practitioner is ultimately responsible for drawing up the treatment plan.

2.2.4  Examination before the treatment

Part of admission for a Treatment is an examination of the Client's medical history. In some cases the client must complete a medical history questionnaire. Using this information, the Practitioner assesses whether there are elevated risks associated with the desired Treatment. If these are unacceptable, the Practitioner will not carry out the treatment.

2.3  Equipment and medical devices

2.3.1  Equipment

The Healthcare Provider guarantees that all equipment used is fit for purpose. This means that the instruments are clean (sterile where applicable) and that the equipment is safe in accordance with the applicable guidelines.

2.3.2  Medical devices

In their work, the Practitioner uses equipment and other medical devices that are registered and whose origin can be traced.

2.4  Aftercare

2.4.1  Information

The Client receives detailed written instructions for the period following the Treatment, as well as personal (verbal) instructions from the Practitioner.

2.4.2  Availability

After the treatment, the Client may continue to call upon the Practitioner if the Client feels unwell or still has questions. The Healthcare Provider is directly available for this on working days from 09:00 to 17:00 on 06-83331555, and outside these hours for emergencies directly via the emergency line.

2.5  Records

2.5.1  Record keeping and retention period

The Healthcare Provider maintains a file relating to the Client's Treatment. Insofar as this is necessary for proper care, the Healthcare Provider records notes on the Client's health data, the procedures performed, and includes other similar data in the file. Client data is retained by the care institution for 15 years. It may be viewed only by you and by those involved on behalf of the Healthcare Provider.

2.5.2  Contents of the file

The Healthcare Provider records in the file, among other things, the particular circumstances identified prior to the Treatment, any materials administered or used, the traceability of materials used, the medical devices used, and the data recorded during the Treatment. Notes are also made during consultations, and before-and-after photographs are held in the file.

2.5.3  Access to the file

At the Client's request, the Practitioner will provide access to and/or a free copy of the file to the Client as soon as possible. If a third party wishes to view the file, the Healthcare Provider will provide this only with the Client's written consent.

2.5.4  Retention period of the file

Unless earlier destruction has been requested in writing, the Healthcare Provider retains the Client file for 15 years from the moment the treatment plan has been fully completed.

2.6  Liability of the Practitioner

2.6.1  The Practitioner's liability

The liability of the Practitioner, insofar as it is covered by their liability insurance, is limited to the amount paid out by the insurer.

2.6.2  Limitation of liability

If in any case the insurer does not pay out, or the damage is not covered by the insurance, the contractor's liability is limited to the amount agreed with the client, or at least to that part of the engagement to which the liability relates.

2.6.3  No liability for consequential loss

The contractor is never liable for consequential loss.

3 What may the Healthcare Provider expect from the Client?

3.1  Medical history

3.1.1  Providing information about medical history

If requested by the Practitioner, the Client will provide all information about their medical history and medication use. The Client will cooperate in supplying or requesting medical data held by other specialists under whose treatment the Client is or has been.

3.2  Expectations, complications and results

3.2.1  Expectations

The Client has understood that cosmetic Treatments lead to improvements but never to perfection. The Client has clearly expressed their expectations and has taken the Practitioner's answers into consideration before entering into this Treatment Agreement.

3.2.2  Complications

The Client has understood that infections and complications may occur during and after the Treatment. Before entering into the Treatment Agreement, the Client has weighed these risks and considers them sufficiently outweighed by the purpose of the Treatment.

3.2.3  Results

During the informative phase, the Practitioner has clearly indicated what the Client may expect from the intended Treatment. The Client understands that the Practitioner cannot guarantee a result and is obliged only to make their best possible effort.

3.2.4  Shortcomings

The Client has the right to address the Practitioner regarding expectations and complications. If the Practitioner has fallen short, the Practitioner must make this clearly known to the Client.

3.3  Payment

3.3.1  Payments

The Client will make the payments for the Treatment as agreed. If for any reason the Client is unable to pay the agreed amounts on time, the Client will notify the Healthcare Provider immediately.

3.3.2  Failure to pay

In the event of late payment, the Client is in default and all payment obligations become immediately due and payable. In the event of late payment, the Client is liable for damages towards the Healthcare Provider.

3.3.3  Interest and collection costs

In the event of late payment, the Client owes statutory interest on the outstanding amount from the date of default, in accordance with Article 6:119a of the Dutch Civil Code. In addition, extrajudicial collection costs will be charged to the Client in accordance with the collection tariff of the Royal Professional Organisation of Judicial Officers, without prejudice to the Healthcare Provider's right to full compensation.

3.3.4  Discounts

Discounts granted by the practitioner to a client are strictly personal and are not transferable to another person.

3.4  Non-attendance and cancellation

3.4.1  Non-attendance

In the event of non-attendance for any surgical procedure, the full amount will be charged if the written treatment agreement is not complied with.

3.4.2  Cancellation

Surgical procedures may be cancelled more than 30 days in advance. The deposit is non-refundable once it has been paid.

For cancellation of surgical procedures within 30 days (not counting the day of cancellation and the day of the procedure), 50% of the total amount will be charged. For cancellation of surgical procedures within 14 days (not counting the day of the procedure), 100% will be charged.

Subject to evidence to the contrary, the Healthcare Provider's records constitute conclusive proof that such an appointment was made.

3.4.3  Termination or suspension of the treatment agreement

Termination or suspension of the treatment agreement is possible if the client behaves improperly or offensively towards the healthcare provider, its staff, or fellow clients.

3.4.4  Missing a consultation

If a consultation is missed without notice of cancellation given more than 24 hours in advance, the amount paid of €1,000 will not be refunded. The Client may schedule a new consultation, which must be paid for again.

3.5  Dissatisfaction

3.5.1  Complaints procedure

If the Client is not satisfied with the way they have been approached, with the treatment, or believes they were not properly informed by the Practitioner, the Client will use the Healthcare Provider's Complaints Procedure by submitting a complaint to info@fuegenix.com. The Client has the right to pursue other avenues regarding their dissatisfaction after the full Complaints Procedure has been completed.

4 General provisions

4.1  Confidentiality

The care institution does not provide any data to third parties without the Client's consent. All employees of the care institution have signed a confidentiality declaration with a penalty clause.

4.2  Privacy policy

The Healthcare Provider maintains a privacy policy, which is made available to the Client on request.

4.3  Changes to the General Terms and Conditions

The General Terms and Conditions and the information stated on the website may be changed by the healthcare provider at any time.
